A. YOUR RIGHTS AS A RELATED PERSON AS A PERSONAL DATA OWNER UNDER THE LPPD NO. 6698
Within the scope of Article 11 of the LPPD No. 6698, everyone is a data controller under ARES MEDIKAL PAZ. VE TIC. LTD. ÅžTI (“ARES MEDÄ°KAL” / “COMPANY”) has the right to apply for the following matters:
To learn whether personal data has been processed,
2. To request information if personal data has been processed,
3. To learn the purpose of processing personal data and whether they are used in accordance with their purpose,
4. To know the third parties to whom personal data has been transferred domestically or abroad,
5. To request correction of personal data if they have been processed incompletely or incorrectly,
6. In accordance with Article 7 of the KVKK No. 6698, in the event that the reasons requiring processing are eliminated, personal data is deleted or destroyed ex officio or upon the request of the relevant person within the framework of the conditions stipulated, despite the fact that it has been processed in accordance with the provisions of this Law and other relevant laws,
7. To request that the transactions made in accordance with the subparagraphs within the scope of Articles 5 and 6 be notified to third parties to whom personal data has been transferred,
8. To object to the emergence of a result against the person by analyzing the processed data exclusively through automated systems,
9. Due to the unlawful processing of personal data request compensation for damages in case of damages.
RELATED PERSON APPLICATION PROCEDURES AND PRINCIPLES
According to Article 13, paragraph 1 of the KVKK and within the scope of the Communiqué on the Procedures and Principles of Application to the Data Controller published in the Official Gazette dated 10.3.2018 and numbered 30356; applications to be made to our Company, which is the data controller, regarding these rights must be submitted to us in writing or by other methods determined by the Personal Data Protection Board ("Board").
The "Related Person", the personal data owner, may notify ARES MEDIKAL of his/her rights and requests specified in paragraph A. In this context, the relevant person may apply in writing in order to exercise all other rights he/she has pursuant to Article 11 of the Law on the Protection of Personal Data No. 6698,
By application in person by the applicant,
• By mail with a signature declaration attached,
• By notary,
• With a secure electronic signature,
• By signing with a secure electronic signature defined in the name of the applicant and sending it to the KEP address specified below,
• By sending from the e-mail address previously notified to the data controller by the relevant person and registered in the data controller's system.
The application must include the following points.
a) Name, surname and signature if the application is in writing,
b) For citizens of the Republic of Turkey, T.R. ID number, nationality, passport number or ID number if any for foreigners,
c) Notification-based residence or workplace address,
ç) Notification-based e-mail address, telephone and fax number, if any,
d) Subject of the request,
(1) Information and documents related to the subject shall be attached to the application.
(2) In written applications, the date the document is notified to the data controller or representative, the application date shall be taken as basis.
(3) In applications made by other methods; the date the application reaches the data controller, the application date shall be taken as basis.
The application shall be finalized free of charge as soon as possible and within thirty days at the latest, depending on the nature of the request. However, if the process requires an additional cost, the fee in the tariff determined by the Board may be charged.
IMPORTANT NOTE: Applications must be made by the person himself/herself. An application on behalf of someone else can only be made by submitting a power of attorney, provided that it contains the content of requesting information within the scope of the KVKK. If ARES MEDIKAL suspects the identity of the applicant, it may request verification information from the relevant person.
